General Provisions
- These Terms and Conditions define the rules for making purchases in the online store operated at www.x4race.com, in particular the rules for placing orders, concluding sales agreements, order processing, delivery, withdrawal from the contract, and submitting complaints.

These Terms and Conditions apply to:
- consumers,
- entrepreneurs with consumer rights.
- To the extent permitted by applicable law, certain consumer rights may not apply to entrepreneurs who do not qualify as entrepreneurs with consumer rights.
- These Terms and Conditions may be available in different language versions. In the event of discrepancies in interpretation, the Polish language version shall prevail.
Definitions
For the purposes of these Terms and Conditions, the following definitions apply:
Seller – NEOTICA sp. z o.o.
Store – the online store operated at www.x4race.com.
Customer – a natural person making a purchase through the Store.
Consumer – a natural person performing a legal act not directly related to their business or professional activity.
Entrepreneur with consumer rights – a natural person entering into a contract directly related to their business activity but which does not have a professional character for that person.
Product – a movable item offered in the Store.
Sales Agreement – a contract concluded between the Customer and the Seller through the Store.
Order – a declaration of intent made by the Customer aimed at concluding a Sales Agreement.
Account – a user account in the Store.
Business Days – days from Monday to Friday excluding public holidays in Poland.
Pre-order – the possibility to purchase a Product before its standard availability.
Product with shipping starting from a specified date – a product whose shipping begins on the date indicated on the product page.
Made-to-order Product – a product prepared or assembled individually upon order with an extended processing time.

Technical Requirements
In order to use the Store, the following are required:
- a device with Internet access
- an up-to-date web browser
- an active e-mail account
- enabled cookies
The Seller shall not be liable for disruptions resulting from incompatibility of the Customer’s devices or software.
Product Information
- The Store offers, in particular, gaming equipment and accessories, including sim racing accessories.

Products may be available in different variants, in particular regarding:
- color,
- configuration,
- equipment.
- Product information, including photos, descriptions, and visual materials, is provided for informational purposes.

Products may have different availability statuses, including:
- available
- temporarily unavailable
- preorder
- shipping from a specified date
- delayed fulfillment
- made-to-order product
Information regarding availability and processing time is presented on the product page.
Prices

Prices in the Store may be presented in the following currencies:
- PLN
- EUR
- CZK
- Prices are gross prices, including VAT, unless stated otherwise.
- Delivery costs are added to the product price during the ordering process.
- The Store may conduct promotions, price reductions, or marketing campaigns.
- Information about promotions is presented in accordance with applicable legal regulations, including the requirements of the Omnibus Directive regarding the presentation of the lowest price from the period preceding the reduction.
Placing Orders
- Orders can be placed via the online store.

The ordering process includes:
- selecting a product
- adding the product to the cart
- providing order details
- selecting the delivery method
- selecting the payment method
- confirming the order
- Placing an order constitutes an offer to conclude a Sales Agreement.
- After placing an order, the Seller sends confirmation of receipt of the order.
- The Sales Agreement is concluded when the Seller sends confirmation of acceptance of the order for processing.

The Seller may refuse to process an order in particular in the event of:
- an obvious pricing error
- product unavailability
- payment issues
- incorrect data provided by the Customer
- justified suspicion of abuse
Payment Methods
The Customer may use the following payment methods:
- Stripe
- PayPal
- bank transfer
- Apple Pay
- Google Pay
- Klarna
- payment cards, including Visa and Mastercard
- BLIK
- AutoPay
- cash on delivery
Availability of payment methods may depend on the country of delivery.
In the case of bank transfer payments, payment should be made within 3 business days.
Delivery
- Products are shipped from Poland.
- Delivery is carried out within countries of the European Union.

Delivery may be carried out by logistics operators, including in particular:
- DPD
- DHL
- InPost
- UPS
- GLS
- FedEx
- Poczta Polska
- Order processing time means the time required to prepare the order for shipment.
- Delivery time means the transport time of the shipment.
- The standard order processing time is up to 1 business day, unless stated otherwise.

In the case of orders including products with different processing times, the Seller may:
- ship the order in a single shipment, or
- propose partial shipment.
Right of Withdrawal
- The Consumer has the right to withdraw from the contract within 14 days without giving any reason.
- The withdrawal period expires 14 days from the day the product is received.

The withdrawal statement may be sent to:

- The Customer bears the direct cost of returning the product.
Return Procedure
In order to exercise the right of withdrawal, the Customer should:
- send a withdrawal statement to the Seller’s e-mail address,
- properly secure the returned product,
- send the product back to the Seller’s address.
The product should be returned no later than 14 days from the date of withdrawal from the contract.
Refunds
- The Seller shall refund the payment within 14 days from receiving the withdrawal statement.
- The Seller may withhold the refund until the returned product has been received.
- The refund will be made using the same payment method used by the Customer.
Complaints
- The Seller is responsible for the conformity of the goods with the contract in accordance with applicable law.
- The liability period is 2 years from the date of delivery of the product.

The complaint should include:
- order number
- description of the issue
- date the defect was noticed
- photos or video recordings presenting the problem
Warranty
- Selected products may be covered by a manufacturer’s warranty.
- The standard warranty period is 12 months, unless stated otherwise.
- The warranty does not limit the rights arising from legal provisions concerning non-conformity of goods with the contract.
Compatibility and Use
- Products are intended for home and gaming use.
- The Customer should ensure that their setup and mounting method allow safe use of the product.
- Compatibility with specific hardware or software may depend on the user’s configuration.
Product Safety
Products offered in the Store should be used in accordance with their intended purpose and the provided instructions.
Customers are obliged to use the products safely and in accordance with their technical specifications.
The Seller shall not be responsible for damages resulting from improper use, improper installation, or use inconsistent with the intended purpose of the Product.
Limitation of Liability
To the fullest extent permitted by applicable law, the Seller shall not be liable for:
- improper use of the Product,
- installation inconsistent with the instructions,
- modifications made by the Customer,
- incompatibility of the Product with the Customer’s hardware or software configuration.
These provisions do not exclude the Seller’s liability where such exclusion would not be permitted under applicable law.
Intellectual Property
All content available in the Store, including in particular:
- trade names
- trademarks
- product designs
- photographs
- descriptions
- graphic materials
constitutes the intellectual property of the Seller or its partners and is protected by applicable law.
Any use of these materials without the prior consent of the Seller is prohibited.
Sales on External Platforms
Products of the X4RACE brand may also be sold through marketplace platforms.
Purchases made outside the x4race.com store may be subject to the terms and conditions of the respective platform.
Personal Data
The rules regarding the processing of personal data are specified in the Privacy Policy available on the Store’s website.
Dispute Resolution (ODR)
Consumers may use the European Commission’s online dispute resolution platform (ODR), available at:
https://ec.europa.eu/consumers/odr
The platform enables out-of-court resolution of disputes arising from online sales contracts.
The Seller is not obliged and does not agree to participate in dispute resolution proceedings before a consumer arbitration board.
Force Majeure
The Seller shall not be liable for failure or delay in fulfilling obligations resulting from circumstances beyond the Seller’s reasonable control, including in particular:
- natural disasters
- war
- strikes
- disruptions in transport or logistics
- decisions of public authorities
- failures of telecommunications or internet infrastructure.
Changes to the Terms and Conditions
- The Seller may amend these Terms and Conditions, in particular due to changes in legal regulations or the functioning of the Store.
- The new version of the Terms and Conditions will be published on the Store’s website.
- Orders placed before the changes shall be governed by the Terms and Conditions in force at the time the order was placed.
Final Provisions
- Matters not regulated herein shall be governed by the provisions of Polish law.
- These Terms and Conditions shall enter into force on 14 March 2026.
